			<content:encoded><![CDATA[<p><a href="http://www.lemontest.net">Lemon test</a> is a type of test that decides when the law will have an effect of establishing a religion. Chief justice Warren Burger formulated the <a href="Lemon test">Lemon test</a><strong>. </strong>The test was introduced in the case of Lemon versus  Kurtzman in the year of 1971.  The Pennsylvania and Rhode Island programs were dealt by Lemon. Salaries of the teachers were supplemented in the religiously based and private schools for the purpose of teaching secular subjects. Both the programs were struck down by the court because both of them violated the clause of establishment. There are three parts of the Lemon test<strong>. </strong>The first part is that there should be a secular legislative purpose in the statute, the second part is that the primary effect will be one that will not advance or inhibit religion and lastly the statute should not foster ‘ an excessive government entanglement with religion’. Everson versus Board of education also forms an important part of Lemon test<strong>. </strong>The test is strongly based on many principles of Everson versus Board of education case. The test is a three pronged test which has been employed developed by the Supreme Court for deciding in the matter regarding the disputes in the establishment clause, for example aid given by state to parochial schools.</p>
<p>Some scholars are of the opinion that the law is inconsistently applied, some found it unprincipled, some are of the opinion that the law is very easily manipulated. Other people say that the Lemon test<strong> </strong>contains very sharp dichotomies (secular or religious ) which can be too rigid for doing justice to the complicated problems of state and church relationships. Some people are of the opinion that the future of Lemon test<strong> </strong>is uncertain. The inconsistent application of the test in some clause of main establishment cases had finally provoked few judges and legal commentators to think that the days of Lemon are numbered. Another reason that has compelled the critic to raise their voice against Lemon test<strong> </strong> is that the central tenets of Lemon are not clearly reaffirmed. There are some courts which apply Lemon test<strong> </strong> in most of their cases and some which apply the test in very few cases. In the year 2000 Supreme court has applied the <a href="http://www.lemontest.net">Lemon test</a>. So one can say that the test I chosen by some and rejected by   others. Sometimes the state assistance towards religious schools are measured by Lemon test<strong> </strong>.</p>
<p>Using the criterias it has been decided by the court that money can be given for the purpose of secular textbooks but not for the repair and development of school. It was also held by the court that students should be released from school if they want to attend religious classes. This is known as released time programs. Recently the court has also started giving public assistance to the religious schools . Thus it can be seen that state is playing a major part in the religious affair and in fact is helping the religious institutions.</p>
